Proposed Legislation May Provide Illegal Immigrants Work ...

Kansas legislators are in a dilemma. Pressure from the local agriculture industry and other industry that are facing acute labor shortages and the possibility of introducing measures that would allow illegal immigrants to work legally in the state, has left them in a quandary.

Both proponents and opponents of the matter testified before the Kansas House committee on Tuesday.

Contrary to the country?s overall unemployment rate, Kansas stood at less than 4 percent. Kansas known for its meatpacking plants, agricultural and the wind power and the oil and gas industry, was facing a severe worker-shortage crisis, with many companies showing loses owing to the missing manpower.

The problem is that these are jobs that native Americans will just not take and the industries are heavily dependent on immigrant labor, especially Hispanic, to do their work for them. Renaldo Mesa, former president of the local chamber of commerce said, ?There are a lot of jobs out here, especially out in western Kansas, that average Americans just will not take.?

Mesa had backed a proposal, to allow illegal immigrants to work, as a Republican member of the Kansas House of Representatives and appealed to the Federal Government for leniency for longtime residents and allow them to work and not to deport them.

Kansas businesses are all supporting the proposal backed by Mesa and want the State to set up a program for illegal immigrants working in certain industries and not to jail or deport them. However, only those immigrants with no criminal records would be eligible for the program. Eligible candidates must also show a willingness to learn the English language and must have lived in the US for more than five years. There employment would be restricted to working only in industries with severe labor shortages

For both it is a win-win situation. They get the workforce they want and the immigrants, who live in dread and are constantly looking over their shoulders; it is a path to doing lawful state authorized work.

However, the Kansas proposal will not easily become law and its fate is uncertain. Can legal immigration laws be changed? The opinions show that it will be a hard stance for the states to take on what is fundamentally a federal issue. Will business interests prevail sufficiently loudly, to silence the growing chorus of vocal crusaders against illegal immigration in the country?

New iPad overly hot? Most tests say no

Recent tests conducted by Consumer Reports suggest that the new iPad runs hotter than its?predecessor. But further tests by other publications ? who struggled to replicate the heat levels observed by Consumer Reports ? point out that this particular result doesn't necessarily mean that the device is overly hot.

Based on Consumer Reports' tests, the new iPad hits temperatures of up to 116 degrees Fahrenheit after about 45 minutes of running an intense-action game. This is up to 14 degrees F warmer than the iPad 2 will run under similar conditions, according to the publication.

After Consumer Reports' report came out, other publications?? such as Wired?and PC World? conducted similar temperature tests. Their results and conclusions didn't precisely line up with Consumer Reports'.

Wired's testers were able to reach temperatures of 108 degrees while re-creating the conditions of Consumer Reports' tests. This falls within the heat levels the iPad 2 hit in Consumer Reports' tests?? not those of the third-generation device.

In additional tests ??which used a different, though still graphics-intensive game ??Wired managed to hit top temperatures of only 94 degrees on the third-generation iPad. "Ninety-four degrees is not an uncomfortable temperature in one?s hands, and it?s also well short of the alarming 116 degrees publicized by Consumer Reports, as well as our own 108 degree reading," remarked Wired's?Roberto Baldwin.

Wired also tested several similar products in order to see how the new iPad's temperature compares. This is how the results broke down:

PC World's test results were quite similar to those seen by Wired.?The publication also tested multiple tablets and found that "any mobile devices get toasty ??and often much hotter than the top temperature of 100 degrees Fahrenheit that [PC World] recorded on the new iPad."

PC World tested multiple scenarios ??plugged in device, unplugged device, etc.???and took temperature measurements on several locations on each test unit.?But no matter what was done, the publication's testers did not manage to "push the new iPad's temperature beyond the century mark."

So what do things boil down to? Well, it seems that the third-generation iPad's heat levels tend to be on par with those of similar devices. And even when they're on the higher side of things, they're not overly hot as even Consumer Reports reviewer Donna Tapellini explained, according to Reuters:

During our tests, I held the new iPad in my hands. When it was at its hottest, it felt very warm but not especially uncomfortable if held for a brief period.

We have reached out to Consumer Reports for further details regarding testing parameters and to confirm whether there are plans to test additional tablets for the sake of comparison. We will update once we receive a response.

Chelsea and Real Madrid won first-leg matches on the road Tuesday night, putting them in good position to advance to the Champions League semifinals.

Salomon Kalou tapped in Fernando Torres' cross in the 75th minute, giving Chelsea a 1-0 win over Benfica in Lisbon, Portugal, the first road win for the Blues in the competition this season.

"It's terrific, you couldn't have hoped for a better result," interim Chelsea manager Roberto Di Matteo said. "Nothing is over - there is still another 90 minutes to play - but we will have home advantage."

In Cyprus, Karim Benzema scored in the 74th minute with a diving header, Kaka doubled the lead in the 82nd and Benzema got another goal in the 89th to give nine-time champion Madrid a 3-0 win at APOEL Nicosia, the first Cypriot team to reach the quarterfinals.

"What they've done, having reached this far is fantastic," Madrid coach Jose Mourinho said. "We needed to play to the maximum of our ability to win. They were great on defense, and they deserve our respect."

Second legs of the total-goals series will be played April 4.

In first-leg games Wednesday night, defending champion Barcelona is at AC Milan and Marseille is home against Bayern Munich.

The New Jersey Experience: Do Insurance ... - Kaiser Health News

On Monday, when the Supreme Court hears arguments about whether the Affordable Care Act is constitutional, the justices will also contemplate a policy issue: Is it possible to reform the private insurance market, making affordable coverage available to all, without an individual mandate?

The Obama administration has told the court that if it invalidates the mandate it should also invalidate two key insurance reforms that would prevent discrimination because of preexisting conditions. On this, the administration has a somewhat unusual ally: The insurance industry. Although insurers have fought many parts of the health law, they have long favored the establishment of a mandate, which requires?almost everyone?who can afford it to?buy health insurance?or pay a fee, saying the reformed market cannot function without it. (Critics point out that a mandate would also help insurers generate more business.)

Legally, the administration's argument is as potent as it is risky. The Constitution says that the federal government may do whatever is "necessary and proper" to carry out its other functions. The Supreme Court historically has interpreted that power broadly. If insurance market reform really is more prone to failure without a mandate, that fact alone could, in the eyes of the justices, make the law constitutional.

But is the administration's claim correct? For some clues, the justices could examine what happened in New Jersey, a state that tried to reform its insurance markets without a mandate -- and failed pretty miserably.

Deconstructing The New Jersey Experience
The New Jersey effort began in the late 1980s, when rising health care costs were getting the attention of business and political leaders across the country. And a big worry then, as now, was what to do about people who couldn't get insurance from a large employer. When those people tried to get coverage in the individual or small-group market, they underwent scrutiny from insurers, who were wary of taking on big medical risks. "Insurance companies make their money not by being efficient, or managing care, but by weeding out the sick and insuring only the healthy," a frustrated Jim Florio, then governor of New Jersey, said in 1992.

The exception was Blue Cross and Blue Shield of New Jersey, which was an "insurer of last resort." By law, and in exchange for its tax-exempt status, Blue Cross could not turn away applicants because of pre-existing conditions. Because that arrangement saddled Blue Cross with sicker and more costly beneficiaries, the state effectively decreed that hospitals charge the insurer less. But that approach was financially straining the state's hospitals, particularly as the number of people without insurance and seeking charity care rose. Blue Cross, meanwhile, maintained that it was struggling even with the extra subsidies -- and kept asking state regulators for permission to impose impressive premium increases.

Eventually the state's stakeholders sat down with lawmakers and, in a negotiation that seems quaintly non-partisan by today's standards, hashed out a deal as part of a broader package of health care initiatives. Blue Cross would no longer be the lone insurer of last resort. Instead, the state would create something called the "Individual Health Coverage Program." Insurers wishing to sell coverage to individual customers would have to do so through this program. And insurers could not deny coverage or charge higher premiums to the sick. In other words, they had to practice what policy wonks call "guaranteed issue" and "community rating." The new law applied similar, although not identical, rules to insurers that sold to small businesses.

The hope was to recreate an environment that had existed many decades before, when the early Blue Cross plans first established modern health insurance in this country. From the 1930s to the 1950s, Blue Cross plans dominated the market, making coverage available to nearly everybody who had the money to pay for it. But then commercial insurers entered the market, targeting only healthy beneficiaries whose small medical needs required much lower premiums -- and leaving the Blue Cross plans with sicker patients, forcing them to raise premiums to unsustainable levels. Around the country, Blue Cross plans bled money, gave up on community rating and guaranteed issue, or some combination of the two -- in other words, they had become victims of what health policy analysts call an "adverse selection death spiral."

New Jersey officials realized their new system might be subject to similar problems. Forcing insurers to charge the same rates universally meant that older, sicker people would pay less -- but younger, healthier people would pay more. Plans might find new, more subtle ways of competing to attract the lowest medical risks, in ways that left other plans with ever-sicker, ever-more expensive beneficiaries. And healthier people might put off buying insurance altogether, since they could always wait until they got sick before getting coverage. To ward off that possibility, the state decided that insurers making more money would subsidize those making less.

The plan went into effect in late 1993, not long before President Bill Clinton's efforts to reform health insurance nationally started foundering. And, for a while, it looked like Florio and his advisers had done what Clinton and his advisors could not. Nobody believed New Jersey's plan would bring universal coverage to the state. But "people thought this would have a significant impact," says Bruce Siegel, who was the state health commissioner and is now president of the National Association of Public Hospitals. "They thought it would ? change the situation for the uninsured."

An early assessment of the program, by researchers at Harvard and sponsored by the Robert Wood Johnson Foundation, declared the experiment a success. But, by 1996, enrollment in the regulated plans started to slide after peaking at about 186,000. By 2001, it was down to about 85,000. Not coincidentally, the mix of people left in the program changed dramatically. According to a study published in?Health Affairs, the median age for enrollees jumped from 41.9 years to 48.4 years in just five years, and premiums rose by between 48 percent and 155 percent, depending on the plan.

These were the tell-tale signs of adverse-selection death spiral: An exodus of healthy people from the insurance pool, leaving behind a population of ever-sicker people whose high health costs keep driving up prices. (The rest ended up uninsured or found their way into other forms of coverage). Ward Sanders, director of the New Jersey Association of Health Plans, says that's exactly what all the stakeholders were seeing. "We had quarterly reports on demographics," says Sanders, who was the state's chief regulator for the individual insurance market during the program's first few years. "And it was empirically indisputable that the claims experience, the medical needs of the population, just went way up."

New Jersey reacted by scaling back its reforms and, in 2003, created a "Basic and Essential" insurance alternative offering fewer benefits, at lower rates. Today, approximately 85,000 have taken up this option. But the B and E plans, as New Jersey calls them, don't cover prescription drugs, rehabilitation, chemotherapy, or transplants. They have no protection against catastrophic expenses, cover delivery but not prenatal care and allow insurers to charge women higher premiums.

Meanwhile, just 49,000 people are still getting comprehensive insurance through the regulated individual market. Overall, those people may still be better off than they would be if New Jersey had never created it. "In a state that allowed medical underwriting ? that allowed insurers to turn away anybody with health problems ? these people would be uninsured," says Joel Cantor, one of the lead authors on that Health Affairs study. But the price of that change is higher insurance premiums overall: By most reckonings, health insurance in New Jersey is among the nation's most expensive.

New Jersey's experience hardly seems unusual. Kentucky, New York and Vermont all tried to reform their insurance markets without a mandate. All ended up with higher premiums, lower enrollment in insurance or some combination of the two.

Does The Mandate Make A Difference?
Would a decision to strike down the Affordable Care Act's mandate impose a similar fate on the U.S. as a whole? That's a more complicated question. Cantor, who is director of the Center for State Health Policy at Rutgers University, notes that other factors were also at work in New Jersey. Not long after the program started, the state rescinded the scheme for compensating insurers that attracted bad risks, because officials came to believe some insurers were gaming the system. The state also stopped offering subsidies to people in the individual market. (Lawmakers did so in order to move funding over to the newly created State Children's Health Insurance Program, which attracted federal matching funds.)

In these respects, the Affordable Care Act might be more resilient. It has relatively generous subsidies, particularly for lower incomes. It also has a "risk adjustment" mechanism that should, in theory, help protect insurers from adverse selection effects. Those buffers are one reason why researchers from the Urban Institute, Rand Corporation, and Congressional Budget Office, as well as Massachusetts Institute of Technology economist Jonathan Gruber, all predict the numbers of Americans without insurance would decline even if the law proceeds without a mandate. It's also possible that, in response to a court decision striking down the mandate, Congress would find alternative methods of boosting participation in the insurance market. (Paul Starr, a Princeton sociologist and historian of health care, has been a prominent proponent of this possibility.)

Still, the economists all believe that the mandate, as envisioned by the law, will make a significant difference in reform's impact. Gruber has suggested that removing the mandate from the law would diminish the number of newly insured by nearly two-thirds and raise premiums overall by 30 percent. The Rand Institute researchers predict that eliminating the mandate would have little effect on premiums for individuals. But they, too, believe that health insurance coverage would fall dramatically -- from 27 million additional people insured to just 15 million.

Those are just projections, but the experts note that one state has managed to impose insurance reforms without weakening its insurance market. It's Massachusetts, which happens to be the one state that also imposed an individual mandate. More than 98 percent of the state's residents now have insurance, by far the highest percentage in the country. Premiums in the non-group market have fallen by 50 percent, relative to national trends, while premiums in the group market aren't rising any faster than they were before the reforms began.

Veterans of the New Jersey experiment certainly think Massachusetts got it right -- and warn that the ultimate effects of reform without a mandate could be even more catastrophic than the mathematical models suggest. "I think the lesson of New Jersey," Sanders says, "is that when you're down to the individual market, where the decision to purchase coverage is in the hands of somebody who is buying for themselves and knows their own health status, it's very hard to make that market work if there's not a mandate coupled with subsidies for folks who need help to meet that responsibility."

Cantor agrees. "If there is guaranteed issue and no mandate, I think it essentially spells the end of the health insurance industry as we know it," Cantor says. "Eventually the insurance market would become so dysfunctional that carriers would pull out, premiums would go through the roof, and enrollment would collapse. That's certainly consistent with what happened in New Jersey."

The Center for Public Integrity: Tea Party-aligned Sen. Jim DeMint donates $500,000 to Club for Growth super PAC

In his quest to remake the Senate Republican caucus in his own image, Tea Party kingmaker Sen. Jim DeMint (R-S.C.) has thrown some serious cash at a conservative super PAC that has attacked a Republican House member and other GOP candidates for office.

Last month, DeMint's campaign committee donated $500,000 to "Club for Growth Action," a super PAC committed to electing pro-free market Republicans. DeMint's donation accounted for 28 percent of the $1.8 million that the super PAC collected in February, according to Federal Election Commission documents released Monday.

To date, Club for Growth Action has reported spending more than $560,000 on political advertisements, all of them negative. The group has attacked House Energy and Commerce Committee Chairman Fred Upton (R-Mich.), as well as U.S. Senate candidates Tommy Thompson in Wisconsin, the state's former GOP governor, and Republican David Dewhurst in Texas, the Lone Star State's current lieutenant governor.

DeMint's leadership PAC has already endorsed Thompson's opponent in Wisconsin, Mark Neumann of Wisconsin, and Dewhurst's opponent in Texas, Ted Cruz. It has also endorsed Don Stenberg of Nebraska and Josh Mandel of Ohio -- both of whom have also been endorsed by the Club for Growth.

"Senator DeMint strongly supports several of the candidates the Club for Growth is backing this year, and this contribution will help the Club push them on to victory," DeMint spokesman Matt Hoskins told iWatch News.

Both DeMint and the Club for Growth favor Republican candidates who favor limited government, lower taxes and pro-growth economic policies. Their staunch support for "the right kind of Republicans," as Hoskins calls it, has frequently led to infighting with GOP party leaders.

During the 2010 midterm election, DeMint and the Club for Growth supported some of the highest profile Tea Party-backed GOP U.S. Senate candidates: Sharron Angle of Nevada, Ken Buck of Colorado, Marco Rubio of Florida, Mike Lee of Utah, Ron Johnson of Wisconsin, Rand Paul of Kentucky, Joe Miller of Alaska and Pat Toomey of Pennsylvania, who resigned as the head of the Club for Growth to run for the seat. DeMint also backed Republican Christine O'Donnell in Delaware, although the Club for Growth did not.

Rubio, Lee, Johnson, Paul and Toomey were all elected to the Senate, while the others went down to defeat.

More moderate Republicans were felled in several GOP primaries, such as Nevada, Colorado and Delaware, where Democrats ultimately retained their hotly contested seats -- and thus, retained control of the U.S. Senate, much to the chagrin of several Republican leaders. But victories in places such as Florida, Kentucky and Utah heartened conservative activists who rejected the candidates pushed by the GOP establishment.

DeMint's half-million-dollar donation is legal thanks to changes in the federal campaign finance landscape in the aftermath of the U.S. Supreme Court's 2010 ruling Citizens United v. Federal Election Commission.

Federal rules limit campaign committees such as DeMint's from donating more than $5,000 per year to a traditional political action committee. Most PACs typically pool together donations from an array of sources and then dole out checks to candidates -- giving no more than $5,000 per election to any one beneficiary. They can also donate only $2,000 per election to another candidate's official campaign committee.

But in the wake of Citizens United, and other federal court rulings and actions by the FEC, PACs that only make expenditures that are not coordinated with candidates and do not donate any money directly to politicians are allowed to accept unlimited contributions from individuals, corporations, unions and other groups -- including candidates' campaign committees.

These spending-oriented groups are frequently called super PACs.

"The reality of super PACs is that they are closely tied to candidates," Paul Ryan, an attorney at the nonpartisan Campaign Legal Center, which favors campaign finance regulations, told iWatch News. "And it's not illegal to have close relationships."

This worries some political observers.

"The more money going through congressional candidates and officeholders, the greater the danger of corruption and illegal coordination," election law expert Rick Hasen, a law professor at the University of California-Irvine said.

DeMint is not the first federal politician to contribute money from his campaign to a super PAC, but he's making a bigger splash than anyone who has come before him.

For instance, last year, the campaign of Rep. Rosa DeLauro (D-Conn.) donated $5,000 to a liberal super PAC called the "America Votes Action Fund." Her colleague Rep. Ed Perlmutter (D-Colo.) donated $1,000 from his campaign war chest to the same group.

Meanwhile, after her unsuccessful Senate bid in Nevada, Angle donated more than $9,500 of her leftover campaign funds to a super PAC that she launched called "Our Voice PAC." And after losing in her Senate race in Delaware, O'Donnell donated $142,000 from her campaign to the super PAC she created, which is called "ChristinePAC."

DeMint, who was elected to his second Senate term in November 2010 with more than 61 percent of the vote, raised $1.9 million in 2011. He ended the year with $1.7 million cash on hand, according to the most recent campaign finance reports his campaign has filed with the Federal Election Commission. He won't stand for re-election again until 2016.

That's on top of the nearly $5.3 million that his leadership PAC has pulled in through the end of February, which is more than any other leadership PAC has raised this election cycle, according to the nonpartisan Center for Responsive Politics. He has used this PAC, which cannot directly aid his own re-election efforts, to funnel hundreds of thousands of dollars of bundled contributions from conservative donors to favored candidates.

Campaign finance observers say it's striking that DeMint used campaign funds, which must be raised under strict contribution limits of just $2,500 per person per election, to contribute to a super PAC, which has no such limits.

"Typically candidates work so hard to raise money under the contribution limits, the last thing they want to do is give it away to someone else," Ryan, of the Campaign Legal Center, said.
